compassionate session contract & model release

COMPASSIONATE SESSION PORTRAIT CONTRACT

I acknowledge that images created by Sarah Sovereign Photography remain copyright and property of Sarah Sovereign Photography. Images may not be edited or altered by CLIENT, including via filters or through apps, and digital files are released to the CLIENT for personal use only. Written permission from Sarah Sovereign Photography must be obtained prior to any sales, publications or contest entries made with the images. Sharing the images on social media is ok, but must include a credit to Sarah Sovereign Photography. 

I understand that typical sessions are 30-60 minutes, but are flexible and structured around the needs to the person/family. There is never any pressure to continue shooting - shortened session times may result in less images, but Sarah Sovereign Photography will do her absolute best to work quickly. I understand that it's important to share any needs/requirement with Sarah Sovereign Photography prior to the shoot: such as mobility requests (accessibility of location, shooting outdoors or indoors), and any other requests that will make the shoot easier and successful. I understand that this shoot is given on a Pay What You Can basis, any payments can be made in cash or e-transfer to sarah@sarahsovereign.com. Please note this is something that is absolutely flexible and can be discussed openly & compassionately with Sarah Sovereign Photography in regards to your needs.  

I understand that Sarah Sovereign Photography will stop the session whenever requested, and that CLIENT can take any time needed during the shoot. 

Sarah Sovereign Photography takes the utmost care with all files, but in the event of loss or damage outside of her control (including but not limited to: card / camera / hard drive malfunction, fire, theft), I agree Sarah Sovereign Photography is not liable. In this unfortunate circumstance, Sarah Sovereign Photography will offer a reshoot as soon as possible.

Once images are delivered to the client, images are archived. A $100 unarchiving fee will be charged for re-delivering files after 30 days, per retrieval. Images are archived for a limited amount of time. I acknowledge that it is CLIENT's responsibility to back up all files, and Sarah Sovereign Photography is not responsible for files after they have been delivered. (Online backups like BackBlaze.com or Dropbox, as well as a USB placed in a fireproof safe are recommended.)  

Editing includes image processing for tone, colour, exposure, sharpness and grain. Extensive edits may be available at an additional charge, dependent upon request. Editing can take up to 6-8 weeks – in the event that editing should take longer, Sarah Sovereign Photography will be in touch as soon as possible. Rush orders may be available for additional fees. 

Standard Model Release (agree or disagree with this portion when filling out the form): I grant unrestricted, irrevocable permission to Sarah Sovereign Photography to use, display, publish, print and exhibit images and/or video taken of me, or of a minor of whom I am a parent/legal guardian. Permission may include, but is not is limited to, photographic competitions, the Internet, mixed media artworks, and art gallery exhibitions. I release all claims to any profits that may arise from these endeavours, and hereby release Sarah Sovereign Photography and its legal representatives and assigns from all claims and liability in relation to said photographs/video/works.

The Photographer (Sarah Sovereign) and licensees or assignees may have unrestricted use of these for whatever purpose, including advertising, with any retouching or alteration without restriction.

I understand that minors (under the age of 18) require a parent/guardian to be on site during the shoot. 

Covid: If anyone present develops symptoms of Covid, the shoot must be rescheduled and Sarah Sovereign Photography must be informed right away, likewise if anyone has been in recent contact with someone who has tested positive. If physical distancing (6 feet apart) is continually breached, this may result in the end of the shoot regardless of time left. All shoots must be outdoors. I have read this contract/model release form carefully and fully understand its meanings and implications. By filling out the form below I agree to the conditions listed above. 

A note about Trade for Print work: When images are delivered, I typically try and send out a list of all the vendors/contributors, and tag according to this list when applicable. Please let me know if I have included an incorrect tag, or have tagged a personal account instead of a professional one. I will include on the list stylists, artists, florists, and other collaborators, please also include them when posting! Thanks so much, and thank you for creating with me!
