24 HR Portrait Project Contract

I acknowledge that images created by Sarah Sovereign Photography remain copyright and property of Sarah Sovereign Photography. Images may not be edited or altered by CLIENT, including via filters or through apps, and digital files are released to the CLIENT for personal use only. Written permission from Sarah Sovereign Photography must be obtained prior to any sales, publications or contest entries made with the images. Sharing the images on social media is ok, but must include a credit to Sarah Sovereign Photography (Facebook.com/sarahisovereign, @sarahsovereign on Instagram and Twitter, www.sarahsovereign.com) .

Retainers are taken to hold the time and date of the session. As Sarah Sovereign Photography blocks off that session spot time exclusively for CLIENT, I understand that retainers/participation fees ($75) are not returned in the event of a cancellation or no show by the CLIENT. Session spots are not guaranteed until fee is paid, if retainer is not paid within 24 hours of booking, the spot will be made available to next in line. If the CLIENT does not show up for their designated time, the $75 will not be returned, and someone else will sub into the spot. Due the time frame of the project, Sarah Sovereign Photography can not accommodate lateness, and late arrival will count as a no show. 

I understand that the $75 nonrefundable participation fee/retainer is for booking the spot only, and that I will receive one complementary digital file as a thank you for my participation. This file can be chosen by you, from a gallery of images shown in the project. Additional files are available for purchase if desired. Files will be sent some time after the completion of the project. The portrait session will occur at a point (chosen by Sarah Sovereign Photography) within the designated hour booked, and be 5-15 minutes in total length. The image taken will be shot by Sarah Sovereign Photography, at her discretion, following the spirit and focus of the project. Reshoots are not possible. 

I grant unrestricted, irrevocable permission to Sarah Sovereign Photography to use, display, publish, print and exhibit images and/or video taken of me, or of a minor of whom I am a parent/legal guardian. Permission may include, but is not is limited to, photographic competitions, the Internet, mixed media artworks, and art gallery exhibitions. I release all claims to any profits that may arise from these endeavours, and hereby release Sarah Sovereign Photography and its legal representatives and assigns from all claims and liability in relation to said photographs/video/works. 

The Photographer (Sarah Sovereign) and licensees or assignees may have unrestricted use of these for whatever purpose, including advertising, with any retouching or alteration without restriction.

Once image is delivered to the CLIENT, the image will be archived. A $100 unarchiving fee will be charged for re-delivering files after 30 days, per retrieval. Images are archived for a limited amount of time. I acknowledge that it is CLIENT's responsibility to back up all files, and Sarah Sovereign Photography is not responsible for files after they have been delivered. (Online backups like BackBlaze.com or Dropbox, as well as a USB placed in a fireproof safe are recommended.) 

In the event of project cancellation, Sarah Sovereign Photography will 1) move the date, or, 2) refund the $75 (should the new date not work.) 

While the utmost care is taken with files, Sarah Sovereign Photography is not responsible in the event of fire, theft, hard drive corruption, or loss of images due to technical failure. In the event that this happens, Sarah Sovereign Photography will be in touch for a portrait reshoot for the project. 

I understand this portrait project is not a full, planned portrait session, and subject to the unpredictability of the nature of the project. Sarah Sovereign Photography retains creative authority over the shoot, time, location, concept and final chosen image of the shoot, and payment is being made for the session spot only. 

I have read this portrait contract form carefully and fully understand its meanings and implications.
